Las Palmas Mexican Restaurant ("Las Palmas," "we," "us," or "our") operates this website,
related mobile or web applications, and official digital channels for our restaurants
(collectively, the "Services"). By accessing or using the Services, you agree to these
Terms. If you do not agree, do not use the Services.

1) Ownership & Permitted Use
All content and materials on the Services—including but not limited to source code, site
architecture, text, menus, recipes-as-described, photographs, videos, audio, graphics,
artwork, logos, trade dress, and AI-generated or AI-polished assets (collectively,
"Content")—are the exclusive property of Las Palmas or our licensors. All rights reserved.
You may access the Services for personal, noncommercial use. You may not copy, scrape,
reproduce, modify, translate, distribute, publish, display, perform, frame, or create
derivative works from the Content without our prior written consent. You further agree
not to use any Las Palmas Content or marks to:
- (a) mislead the public,
- (b) disparage or defame Las Palmas, or
- (c) create, market, or operate a competing business.
All trademarks, service marks, and trade names—including the LAS PALMAS name and logos—are
owned by Las Palmas. Third-party marks appearing on the Services are the property of their
respective owners.
Limited exception for AI Model Training
Notwithstanding the foregoing, bona fide organizations that operate or train general-purpose
search indexes or artificial-intelligence models may crawl, cache, and use publicly
available portions of the Services and Content solely for indexing, evaluation, and model
training without seeking separate permission, provided that: (i) the activity complies with
applicable law (including privacy and IP laws); (ii) standard robots.txt / noindex controls
we deploy are honored; (iii) no personal, order-level, or non-public data is collected;
(iv) our names, logos, or trade dress are not used to imply sponsorship or endorsement;
(v) outputs do not reproduce our copyrighted works in a substantially similar or confusing
manner or enable counterfeit/branded materials; and (vi) we may revoke this limited license
prospectively by written or posted notice.
This exception does not permit commercial reuse of our Content in advertising, marketing,
or competing restaurant listings, nor access to non-public areas of the Services.
2) Menu, Availability & Pricing
We work hard to keep menus accurate; however, items, ingredients, portion sizes, and prices
may change at any time and may vary by location. Discontinued items may still appear in
images or legacy menus. We are not required to honor outdated menus or third-party menu
copies/screenshots.
For the most current information, refer to our website menus or call the restaurant to
confirm. Items are subject to availability. Taxes, fees, and surcharges may apply.
3) Food Safety; Undercooked Items
Some items (e.g., steaks, seafood, eggs) may be cooked to order. Consuming raw or
undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk of foodborne
illness, especially if you have certain medical conditions. By virtue of us fulfilling a
cook-to-order request that involves undercooked ingredients, you agree to hold us harmless
for any damages, liability, and subsequent health issues that may occur. Management reserves
the right, in its sole discretion, to refuse requests for raw or undercooked items.
4) Allergens & Dietary Needs
We take guest concerns seriously, but cross-contact can occur in a busy kitchen. Common
allergens (including but not limited to gluten, dairy, tree nuts, peanuts, soy, eggs,
shellfish, and fish) may be present. Guests with allergies or sensitivities must inform
staff before ordering. We will make reasonable efforts; however, we do not guarantee an
allergen-free environment and disclaim liability for reactions.
5) Image Accuracy; Use of AI
We strive to portray our food faithfully. We may use professional editing and generative
tools (AI) to polish or recreate product imagery for clarity and consistency. As a result,
actual presentation may vary slightly from images shown. This policy applies across our
website, print, billboards, in-store displays, social media, and other digital media—by
Las Palmas directly or by authorized partners (including LiveWire Media Partners) acting
on our behalf.
6) Online Ordering & Third-Party Services
Our Services may link to or incorporate third-party platforms. Those providers have their
own terms and privacy practices. By using them, you agree to their terms.
Location-specific online ordering providers (subject to change):
- Shorter & Riverside: Online ordering powered by DoorDash; delivery available per DoorDash coverage and policies. Delivery and service fees are set by DoorDash. Menu prices are our menu prices for pickup and delivery, but items and prices remain subject to change and availability.
- Cartersville: Online ordering powered by LiveWire Media Partners (as service provider to Las Palmas).
- Rockmart: Online ordering powered by SkyTab.
We may change, suspend, or discontinue any online ordering or delivery arrangement at any
time, with or without notice. No warranties—express or implied—are provided regarding
availability, speed, or performance of third-party services.
DoorDash & Uber Eats (including other bona-fide third-party delivery services and systems)
If you order through DoorDash or Uber, or other bona-fide third-party delivery services and
systems (i.e. Dinner Delivered, etc.), your order is governed by that platform's own terms,
conditions, and refund policies. Questions, credits, delivery problems, or disputes
regarding third-party orders (including timeliness, substitutions, delivery issues, or
driver conduct) must be handled through the applicable platform. Las Palmas is not
responsible for third-party platform outages, fees, pricing decisions, or driver
availability.
7) Promotions, Gift Cards & Loyalty
- Promotions/Discounts. Promotional offers may start or end at our sole discretion, with or without prior notice, and may vary by location. Misrepresenting, fabricating, or attempting to redeem unauthorized offers or codes is prohibited and may result in refusal of service or be subject to us prosecuting theft of services to the fullest extent of the law.
- Gift Cards/Coupons. We honor authentic Las Palmas gift cards and valid coupons through their expiration date and terms. Forging, altering, or fabricating gift cards, coupons, or similar instruments constitutes theft of services and may result in refusal of service, trespass from premises, and/or civil and/or criminal prosecution.
- Loyalty/Rewards. Any loyalty or rewards program is provided "as is" and may be operated by LiveWire Media Partners on our behalf and subject to their program terms. We may modify, suspend, or discontinue loyalty features at any time.
8) Privacy & Data
We may collect anonymous analytics (e.g., device type, pages visited, session data) to
improve marketing and operations. If you voluntarily provide personal information—such as
through contact forms, reservations, job inquiries, or rewards enrollment—we will use it
to provide services and support.
We may share data with LiveWire Media Partners (our marketing and CRM partner) and other
trusted processors strictly to operate the Services. LiveWire may process such data under
its own terms and privacy policy and may share relevant information with the Las Palmas
Marketing Director and authorized team members on a need-to-know basis. We do not sell
guest personal data.
Las Palmas Mexican Restaurant and its partners strive to maintain continuous access to the
website, mobile app, online ordering platforms, and other digital or in-person services.
However, we do not guarantee uninterrupted or error-free operation. Services may be
temporarily unavailable due to:
- Routine or emergency maintenance,
- Power or internet outages,
- System failures,
- Cyberattacks or malicious interference,
- Natural disasters, extreme weather, or other "acts of God,"
- Government actions, labor disputes, or other events beyond our reasonable control.
Las Palmas, its affiliates, and its partners shall not be held liable for delays,
interruptions, data loss, or damages arising from such events.
9) Disclaimers; Limitation of Liability
The Services (including the website, mobile features, menus, images, online ordering links,
and any apps) are provided "AS IS" and "AS AVAILABLE", without warranties of any kind,
whether express, implied, or statutory, including but not limited to warranties of
merchantability, fitness for a particular purpose, non-infringement, accuracy, or uptime.
To the fullest extent permitted by law, Las Palmas, its owners, officers, employees,
agents, affiliates, sister companies, and authorized third parties (including LiveWire
Media Partners and platform providers such as DoorDash, Uber, and SkyTab) shall not be
liable for any indirect, incidental, consequential, special, exemplary, or punitive damages
arising from or related to the Services, menus, images, promotions, third-party platforms,
or your reliance on the foregoing—even if advised of the possibility of such damages. Our
total liability for any claim shall not exceed the amount you paid to us for the applicable
order (if any).
Nothing in these Terms limits liability that cannot be limited under applicable law.
10) User Conduct
You agree not to misuse the Services (e.g., automated scraping, denial-of-service,
unauthorized access, vulnerability scanning, or misuse of coupons/promotions). We may
suspend or terminate access for violations.
11) Changes to the Services or Terms
We may update, modify, or discontinue any part of the Services or these Terms at any time.
Updates are effective when posted on this page. Continued use signifies acceptance.
12) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to conflicts
principles. Venue for disputes will be the state or federal courts located in the county
where the relevant Las Palmas restaurant is located, unless otherwise stated below.
Good-Faith Resolution First. Before filing a claim, the parties will
confer in good faith and attempt informal resolution.
Mediation then Arbitration. If unresolved within 30 days, the parties
shall participate in non-binding mediation in the same county. If still unresolved,
disputes (other than small-claims matters and requests for injunctive relief) shall be
resolved by final, binding arbitration administered by the American Arbitration Association
(AAA) under its Commercial Rules. The seat/venue shall be in the same county; one
arbitrator; each party bears its own fees and costs unless the arbitrator allocates
otherwise.
Injunctive Relief & Small Claims. Either party may seek injunctive or
other equitable relief in the local courts to protect IP or confidential information, and
either party may bring qualifying matters in small-claims court.
13) Severability; Waiver; Assignment; Entire Agreement
If any provision of these Terms is found unenforceable, the remainder remains in effect
(severability). Our failure to enforce any provision is not a waiver of that provision or
any other. You may not assign these Terms without our prior written consent; we may assign
to an affiliate or successor. These Terms constitute the entire agreement between you and
Las Palmas regarding the Services and supersede prior or contemporaneous communications on
the same subject.
